A Termination Agreement executed as a deed, together with an executed but unregistered transfer, is sufficient to sever a joint tenancy in equity before the death of one joint tenant, defeating the right of survivorship. A claim for a constructive trust over property purchased in one party's name requires evidence of common intention and financial contribution; being a signatory on the purchaser's bank account does not establish a beneficial interest. A former domestic partner who received substantial payments during the relationship and entered into a property settlement agreement may still be entitled to modest family provision where no provision was made in the will.
