A costs order will be set aside where the trial judge's exercise of discretion proceeded on an incorrect factual basis, including where the judge attributed delay to a party who was in fact prevented from taking steps by a stay order that was later set aside as wrongly made. Where proceedings become otiose partly through the applicant's delay and partly through delay not attributable to the applicant, the appropriate order may be no order as to costs.
