A costs assessor assessing party/party costs under multiple costs orders must make a separate determination for each order and issue separate certificates, even where the orders are the subject of a single application. A single global certificate expressing an undivided sum does not comply with the Legal Profession Act 2004 (NSW). Section 369(3)(c) of the Legal Profession Act, which imposes liability for costs of assessment where costs are reduced by 15% or more, applies only to practitioner-client costs and not to party/party costs. Legal aid protection under s 47 of the Legal Aid Commission Act 1979 (NSW) does not extend to the partners of a legally assisted person.
