Where a solicitor's non-compliance with court orders causes costs to be incurred without reasonable cause, the court may order the solicitor to pay those costs directly to the opposing party under s 99 of the Civil Procedure Act 2005 (NSW). The abandonment of grounds of appeal may justify a percentage reduction in the successful appellant's recoverable costs, even where the general rule that costs follow the event applies.
