When the Tribunal exercises its discretion under s 183(1) of the Strata Schemes Management Act 1996 (NSW) to reallocate unit entitlements, it is entitled to take into account the effect of the proposed reallocation on the control of the owners' corporation, including whether it would confer on one lot holder a level of control not previously enjoyed or create the potential for deadlock. The 'respective values of the lots' under s 183(3) is a fundamental but not exclusive consideration. The meaning of 'value' in s 183(3) — whether market value or land value — was left open.
