Where the Fair Work Ombudsman brings proceedings asserting an employee's entitlements against an employer, and the employee participates by providing evidence and declarations and orders are made for the employee's benefit, the Fair Work Ombudsman is the employee's privy in interest for issue estoppel purposes. A finding of employment in such proceedings will estop the employee from denying that employment relationship in subsequent proceedings. The concept of employment for the purposes of federal award entitlements is the same as for state workers' compensation legislation.
