The absence of a 'no genuine dispute' statement from the affidavit accompanying a statutory demand under s 459E(3) of the Corporations Act 2001 (Cth) is, of itself, 'some other reason' to set aside the demand under s 459J(1)(b). This deficiency cannot be cured or offset by factual matters, including the debtor company's failure to establish a genuine dispute on the merits or the absence of prejudice. Creditors serving statutory demands must ensure strict compliance with Form 7, including the paragraph 5 statement of belief.
