UCPR r 12.7 (failure to prosecute with due despatch) is capable of encompassing a failure to bring pleadings into good order, particularly where a plaintiff declines to utilise interlocutory procedures made available by the court and ignores points properly taken in correspondence. In defamation, a person who merely contributes material to a television broadcast but has no control over the publishing process will not ordinarily be liable as an original publisher of the whole broadcast unless they assented to its final form. Leave to appeal from interlocutory strike-out orders will ordinarily be refused where the applicant has been given leave to re-plead at first instance.
