Section 68(1) of the Evidence Act 1995 (NSW) fixes a time limit for objections to hearsay evidence served under s 67 notice; failure to object within time precludes later objection. Transcripts of evidence from prior criminal proceedings may be tendered in civil proceedings under s 64(2)(b) where the maker is available but it would not be reasonably practicable to call them (including by reason of psychiatric infirmity) or where calling them would cause undue expense or delay, particularly where the evidence was given under oath and tested or available to be tested by cross-examination.
