The cost exemption in reg 15 of the Strata Schemes Management Regulation 2005 (NSW) requires the reasonably estimated cost of the entire proposed proceedings, not merely the costs of an initial stage. Providing a series of stage-by-stage estimates each under $10,000 does not satisfy the exemption. Contravention of s 80D does not automatically invalidate proceedings but the court retains a discretion to dismiss them. A deliberate forensic decision not to seek ratification before trial will preclude a party from seeking to reopen after an adverse judgment to rely on post-judgment ratification.
