An order under UCPR r 20.14 referring questions of foreign law must appoint a specific person as referee and identify the question to be referred; the MOU between the Chief Justice of NSW and the Chief Judge of New York does not apply to such references. The specific power in r 6.44(2) does not constrain the general referral power in r 20.14, and there is no requirement that non-consensual references be made only in exceptional circumstances.
