Findings made in proceedings brought by a different plaintiff against the same defendant do not automatically entitle a subsequent plaintiff to have those findings treated as established. A court should not compel a defendant to admit matters found in earlier proceedings by another plaintiff unless it would be unfair to require proof in the usual way or the requirement would bring the administration of justice into disrepute. Precise correspondence between the prior findings and the allegations in the current proceedings is required.
