A non-parole period of approximately one quarter of the standard non-parole period for a s 112(3) offence that is not below the mid-range of seriousness is manifestly inadequate. The assessment of objective seriousness remains a critical component of sentencing post-Muldrock, and sentencing judges must give practical recognition to the standard non-parole period as a guidepost. Offences committed in a domestic violence context require greater weight to be given to deterrence, denunciation and community protection.
