A concession of Muldrock error does not automatically result in a lesser sentence; the Court will conduct a fresh sentencing exercise and may impose the same sentence if the objective and subjective circumstances warrant it. Surrender to police does not attract a discount under s 23 of the Crimes (Sentencing Procedure) Act 1999 (NSW) where the offender's identification was inevitable and the surrender was motivated by a desire to make excuses rather than genuinely assist authorities.
