A notice under a building contract termination clause must contain an unequivocal statement of intention to determine the builder's employment; a notice expressing only an intention to investigate or assess the builder's capability to complete the works is insufficient. A builder's failure to proceed with due diligence by reason of delay is a default capable of remedy, and remedy does not require producing the same condition of affairs as if the breach had never occurred — a substantial resumption of work with reasonable diligence and competence suffices.
