The Storage Liens Act 1973 (Qld) does not confer a storer's lien on cattle agisted under a contract that is not exclusively or primarily for storage, particularly where the contract contemplates the cattle being agisted as a producing herd. Agisters seeking security over agisted cattle must rely on contractual arrangements rather than the statutory lien. The long title of a Queensland Act ('An Act to amend the law relating to warehousing of goods') may be used to constrain the scope of operative provisions without first identifying an ambiguity.
