In multi-complainant sexual offence trials where the trial judge determines the evidence of each complainant is not cross-admissible, the jury must be specifically directed that it cannot use the evidence of offending against one complainant to support proof of charges relating to the other, and must be warned against propensity reasoning. A direction to consider each count separately is insufficient. There is no neutral position: directions must be given whether the evidence is ruled cross-admissible or not.
