A sentencing judge exercising the discretion to record or not record a conviction under s 12 of the Penalties and Sentences Act 1992 (Qld) is not required to consider, of the judge's own motion, the impact of reporting obligations under the Child Protection (Offender Reporting) Act 2004 (Qld) on the offender's social wellbeing where no submission is made and no material supports such a finding. Defence counsel seeking to rely on the impact of offender reporting obligations must raise the issue by way of submission at sentence.
