Targeting a vulnerable community (here, Indigenous communities in the APY Lands) for drug supply is a seriously aggravating feature of the offending. Uncharged offending forming part of a course of conduct is background information relevant to leniency and rehabilitation but should not increase the sentence beyond what is appropriate for the charged offences. When comparing sentences across jurisdictions with different offence structures (individual transactions vs continuing offence), regard must be had to both the particular charges and the context of the charged offending.
