A Director's appeal against sentence cannot succeed on the basis of specific error alone without establishing manifest inadequacy; a finding regarding rehabilitation prospects, even if erroneous, does not of itself warrant appellate intervention. Rehabilitation cannot be permitted to overwhelm all other sentencing factors, particularly deterrence, denunciation and community protection, in cases of serious repeat child sex offending. Where a sentencing judge considers imprisonment should be imposed in conjunction with a CCO, the statutory three-month limit on the imprisonment component must not lead to artificially shortened terms.
