A non-parole period of less than 50% of a substantial head sentence is wholly exceptional and can only be justified by wholly exceptional circumstances of the offences and the offender. Rehabilitation prospects that are no better than reasonable — particularly where qualified by lack of insight, empathy and refusal to accept responsibility — do not constitute exceptional circumstances warranting such a departure from the usual sentencing practice range of 60-75%.
