Section 50(3) of the Accident Compensation Act 1985 (Vic) overrides the general costs discretion in s 78(1) of the County Court Act 1958, constraining costs to the Magistrates' Court scale where the proceeding could have been brought in the Magistrates' Court. Section 100(2)(c) of the Magistrates' Court Act 1989 only excludes jurisdiction for actions to enforce unsatisfied superior court judgments, not proceedings merely arising out of or connected with such judgments.
