Where co-offenders in a joint criminal enterprise are found equally culpable, significantly different antecedents — particularly where one co-offender is sentenced as a serious violent offender with extensive prior convictions and the other has no relevant priors — must be reflected in different sentencing outcomes. The absence of prior convictions creates a legitimate expectation of more favourable treatment relative to a co-offender with extensive priors, even where culpability in the offending is equal.
