When fixing penalty for professional misconduct, a tribunal must give adequate consideration to why a substantial compensation order already made in respect of the same conduct would not be an adequate deterrent. A compensation order of $100,000 reflects a large measure of denunciation and is likely to provide considerable specific and general deterrence. Cancellation of a sole practitioner's certificate for eight months, in addition to such a compensation order, may be manifestly excessive where the misconduct arose from unique circumstances with a low risk of reoffending.
