Section 123 of the Evidence Act 2008 (Vic) (and its equivalents in the Commonwealth and NSW uniform Evidence Acts) does not permit an accused to compel a prosecution witness to disclose privileged communications in cross-examination. The phrase 'adducing evidence' in s 123 refers only to the adducing by an accused of evidence already in the accused's possession or knowledge. Legal professional privilege remains a valid ground of objection by a prosecution witness to answering questions that would disclose privileged communications. Section 131A does not apply to cross-examination, which falls within the scope of 'adducing evidence' rather than 'disclosure requirement'.
