A custody order under s 18(2) of the Major Crime (Investigative Powers) Act 2004 may be amended to substitute a different police officer, provided the substituted officer applies for the amendment. The limitation in s 18(2) requires that the officer into whose custody the person is to be delivered must be the applicant for the relevant legal instrument, whether the original order or an amendment. Section 20 of the Police Regulation Act 1958 (now s 56 of the Victoria Police Act 2013) may also permit execution of such an order by a different officer without amendment.
