An employer's acceptance of liability for an injury under s 104B(2)(a) of the Accident Compensation Act 1985 does not preclude a medical panel from assessing the degree of permanent impairment as 0% where the compensable injury (being an exacerbation of a pre-existing condition) has resolved. The acceptance of liability is confined to the compensable injury causally related to the workplace incident and does not constitute an admission that any permanent impairment exists. A claim for weekly payments under s 93 and a claim for lump sum impairment benefits under s 98C are different 'questions or matters' for the purposes of s 68(4), so a medical panel assessing impairment for s 98C purposes is not bound by a previous panel's opinion given for s 93 purposes.
