Section 9(4) of the Sentencing Act 1991 (Vic) abrogates the obligation identified in DPP v Felton to identify separate events giving rise to specific charges or to specify the contribution of each charge to an aggregate sentence. When imposing an aggregate sentence, the sentencing judge considers the offender's conduct as a whole, and the question of double punishment is unlikely to arise. Sentencing remarks should be read as a whole, fairly and not perversely, and not subjected to overzealous scrutiny.
