Where a statutory scheme is amended to preclude the occurrence of a condition precedent to a statutory entitlement, the entitlement is not triggered even though it has not been expressly repealed. A government promise to deal 'reasonably and in good faith' is contractually binding where it is separate from expressly non-binding principles, but its content is circumscribed by those non-binding principles such that a failure to legislate to preserve an entitlement expressly stated to be non-binding cannot constitute a breach.
