Failure to comply with case workers' directions does not constitute a breach of a supervision order condition incorporating s 20 of the Serious Sex Offenders (Detention and Supervision) Act 2009 (Vic), as s 20 only authorises the Adult Parole Board to give directions. Section 5(2BD) of the Sentencing Act 1991 (Vic) prevents a supervision order from affecting sentence length in either direction but does not prevent the court from considering the order as an essential fact of the offending. The non-publication provisions in s 182 of the Act do not bind the court, as a court is not a 'person' within the meaning of the section and handing down reasons is not 'publishing' within the statutory definition.
