When assessing parity between co-offenders, the ratio between non-parole periods should broadly align with the ratio between total effective sentences. A disparity that is the same in absolute terms but disproportionately greater in percentage terms at the non-parole period level may give rise to a justifiable sense of grievance. The failure of trial counsel to seek an anti-propensity direction, where such failure may have been a rational forensic decision, presents a serious obstacle to raising the issue on appeal.
