Section 11.1(7) of the Criminal Code Act 1995 (Cth) does not preclude a conviction for jointly attempting to commit an agreed offence under s 11.2A; it only precludes a charge of attempting to enter into a joint criminal enterprise. The prosecution is not required to prove knowledge or belief as to commercial quantity for attempted possession of unlawfully imported drugs, whether charged as an individual attempt or on the basis of joint commission, by reason of the special liability provisions in ss 11.1(6A) and 11.2A(8).
