Where a conviction is set aside on appeal and the offender is subsequently re-sentenced on a lesser charge with a lower sentence, the Court of Appeal may consequentially reduce a licence disqualification order that was confirmed on the earlier appeal, having regard to the statutory minimum disqualification for the remaining offences, the overall sentence, delay, and rehabilitation findings.
