Where multiple lawyers have given only 'guarded' advice as to the prospects of appeal, this does not constitute an adequate explanation for delay but rather suggests the appeal lacks merit. Where the delay is of this order, the applicant must show the appeal would 'probably succeed', not merely that it is arguable.
