A party seeking recovery of money paid under mistake must adduce evidence that the payer believed it was under a legal obligation to make the payment, and that this mistaken belief caused the payment. General evidence of a desire to assist an acquaintance who had done work is insufficient. Where there is a gap between the alleged mistake and the date of payment, the claimant must prove the mistake subsisted at the time of payment.
