The Hazeldene factors for assessing unreasonableness of refusal of a Calderbank offer apply equally to offers of compromise made under r 26.12 of the Supreme Court (General Civil Procedure) Rules 2005 (Vic). An offer of approximately two-thirds of the trial result, open for 14 days, where the appeal has obvious merit, will be regarded as a very attractive offer whose refusal is unreasonable.
