An 'offer of compensation' under Part 10 of the Land Administration Act 1997 (WA) must relate to the land actually compulsorily taken; an offer in respect of a larger area of land (including portions not validly taken) is not a valid offer of compensation and cannot ground the Tribunal's jurisdiction under s 222. The rejection of such an offer is a jurisdictional fact. The majority held that s 50 of the SAT Act can be exercised to refer compensation matters to the Supreme Court even after the acquiring authority has invoked s 222, provided the claimant undertakes to commence proceedings, though Buss JA dissented on this point.
