A contract for the sale of a lot in a subdivision entered into by a vendor in contravention of s 13(1) of the Sale of Land Act 1970 (WA) is unenforceable by the vendor but enforceable by the purchaser. The unenforceability is permanent and is not cured by the vendor subsequently obtaining registered title. The Act does not confer on the purchaser a statutory right to rescind or avoid the contract, but does not exclude rights arising under the general law or other statutes.
