An affidavit in support of summary judgment under O 14 r 2 of the Rules of the Supreme Court 1971 (WA) need not use the specific verbal formula 'I have been informed by X and verily believe that Y'; it is sufficient if the affidavit, read as a whole, identifies the sources and grounds of statements of information and belief. Where documents annexed to the affidavit are admissible by force of statute (such as business records or evidentiary certificates), those documents themselves constitute the relevant source of evidence and the deponent need not separately depose to their truth. The observation that primary evidence should be adduced where available goes to weight, not admissibility.
