The combination of advanced age, degenerative health conditions (particularly Parkinson's disease and dementia), and the absence of any need for personal deterrence can render a sentence that would otherwise be appropriate a breach of both limbs of the totality principle. When comparing sentences for historical sexual offences, direct comparison with sentences imposed under current provisions carrying higher maximum penalties is inappropriate.
