Periods spent in residential rehabilitation may be credited against a sentence at a discounted rate of 50% when resentencing for breach of a good behaviour order. A non-parole period on resentencing may be calculated by reference to the unserved balance of the original sentence rather than the original total sentence. The question whether an incorrect sentence that has been cancelled can subsequently be corrected under s 61 of the Crimes (Sentencing) Act 2005 (ACT) was left open.
