An ex parte stay pending appeal will not be granted where the applicant has not established a prima facie case for extension of time and leave to appeal, and there is no evidence of imminent prejudice justifying ex parte relief. The smallness of amounts in dispute remains a significant obstacle to obtaining leave to appeal. The Court of Appeal's jurisdiction under s 127 of the District Court Act 1973 (NSW) does not extend to statutory appeals to the District Court from other jurisdictions, including appeals from a Costs Review Panel.
