Where a solicitor holds concurrent retainers from different clients in the same matter with the clients' informed consent, information common to both retainers is 'shared information' and is not confidential as between the clients. A retainer is not deprived of 'practical content' merely because the client is ultimately found to lack standing. In breach of confidence claims, the plaintiff must prove causation of loss by evidence supporting a positive inference, not mere speculation that the disclosure encouraged continuation of proceedings.
