A settlement agreement that defers a party's obligation to complete a contract of sale does not, without express provision, relieve that party from an accrued obligation to pay interest under a special condition that operates independently of default. Preservation clauses stating that the settlement does not 'otherwise affect' the terms of the underlying contract have real work to do and will be given effect. Where the same word is used in different clauses of the same agreement addressing the same subject matter, it should be given the same meaning.
