A statutory policy arising under s 58 of the Insurance Contracts Act 1984 (Cth) is not itself 'renewable insurance cover' within s 58(1), so the insurer's failure to give notice of its expiry does not generate a further statutory policy. An insurer's failure to invite renewal of a home insurance policy, even while continuing to deal with the insured on a claim under an earlier policy, does not constitute misleading or deceptive conduct where the policy terms do not promise renewal and the claim dealings are unrelated to the current policy's status. The question whether inadvertent omissions can constitute 'conduct' for the purposes of s 12DA of the ASIC Act was left open.
