An order cancelling a health practitioner's registration that has already taken effect has no continuing operation capable of being stayed. Where a statutory right of appeal exists from NCAT, that remedy should be pursued before seeking judicial review under s 69 of the Supreme Court Act 1970 (NSW), and the failure to do so will generally provide a reason for refusing both a stay and judicial review relief.
