An appellate court will not disturb a trial judge's adverse credit findings where contemporaneous documentary evidence (particularly solicitor diary notes and correspondence) is inconsistent with the witness's account, even where the appellant argues that the commercial circumstances make the witness's version more plausible. Evidence of alternative commercial explanations (here, a developer's interest at a higher price) can defeat an argument based on alleged commercial irrationality.
