Subpoenas in insurance theft claims must be proportionate to the specific suspicious circumstances identified, even where the insurer has legitimate grounds for investigation. Broad, unspecific subpoenas for criminal records, telecommunications data and vehicle registration records of parties and witnesses will be set aside as fishing expeditions where they are not limited to material rationally connected to the identified suspicions. The absence of a fraud plea does not preclude credibility challenges but constrains the scope of permissible investigation. Insurers are not precluded from issuing further, more narrowly drawn subpoenas after overly broad ones are set aside.
