A party who fails to raise an available argument of law in a statutory appeal to the District Court from a tribunal decision may be precluded by Anshun estoppel from raising that argument in subsequent judicial review proceedings challenging the tribunal's decision. The fact that the party's legal representatives were unaware of supporting authority does not excuse the failure if the argument was independently available with reasonable diligence. A court does not commit an error of law on the face of the record merely because it dismisses an appeal without addressing a question of law that was never put to it by the appellant.
