A court's analysis and reasoning need not precisely reflect the position taken by either party; what matters is whether the reasoning involves such a departure from the territory mapped out by the parties' cases as to constitute denial of a fair hearing. The fact that a court refers to additional authorities not cited by the parties does not of itself bespeak lack of procedural fairness.
